Плахотнюка осудят заочно?
Рассмотрение ходатайства
о завершении уголовного расследования дела о банковскои мошенничестве в
отсутствие обвиняемого Влада Плахотнюка будет проводиться с участием
назначенного адвоката.
Антикоррупционная прокуратура потребовала сделать это после
того, как последнее судебное заседание было отложено по причине неявки адвоката
Плахотнюка. Следующее заседание запланировано на 17 ноября, передает IPN.
22 августа АП направила ходатайство следственному судье Кишиневского суда, офис Чоканы, с просьбой дать согласие на завершение уголовного расследования в отсутствие обвиняемого. Защита обратилась в КС с просьбой об отмене исключения о неконституционности новых положений, внесенных недавно в УПК. 29 сентября суд объявил обращения адвокатов неприемлемыми.
Проведено шесть судебных заседаний, на которых адвокаты вносили новые ходатайства об отмене исключения о неконституционности, ходатайства об отводе, ходатайства о переносе дела, ходатайства о переносе судебного заседания, а прокуроры постоянно выступали за отклонение этих исков.

Плахотнюк, если будет осуждён, выиграет суд в Европе и добьётся и добьется на проведение над ним нормальное судебное разбирательство. При рассмотрении этого дела суд должен обязательно поставить вопрос о конституционности Закона о рассмотрении дел в отсутствии подсудимых. Конституция ведь запрещает такие процессы.
